Chennai: Madras high court on monday dismissed an election petition moved by former DMK minister K R Periyakaruppan challenging the election of TVK MLA R Seenivasa Sethupathi by one vote in Tirupattur assembly constituency.Justice G K Ilanthiraiyan passed the order while allowing a plea moved by Seenivasa Sethupathi for rejecting the election petition moved by Periyakaruppan.Seenivasa Sethupathi had secured 83,375 votes while Periyakaruppan got 83,374 votes and lost the election by a margin of one vote.Periyakaruppan alleged that one postal vote had been wrongly sent to the constituency with the same name in Tirupattur district and that the returning officer had cancelled the vote, instead of sending it back to the actual constituency.However, Sethupathi denied the allegation and contended that the postal vote sent to the other constituency had an unambiguous mention of the constituency’s name and number and that it did not belong to the one in Sivagangai district.
